  1.  General Provisions

    1. The present site www.verso-onlinestore.be (hereinafter Site) is owned by Verso and is operated by Verso NV, a company which is owned and operated by Verso NV with principal seat of business at:

    1. The present general terms and conditions (hereinafter “Terms and Conditions”) regulate the relationship between the Customer (hereinafter the Customer) and Verso NV (hereinafter referred to as Parties) for the purchase of the Verso products (hereinafter Products) from time to time available on the Site.
    2. The following purchase agreement may be entered in the following language: English, Dutch and French.
    3. For the purpose of the present Terms and Conditions, by Customer, we refer exclusively to the consumer, in any case to a person that purchases the products for non professional or business purposes.
    4. The Customer is requested to read carefully the general terms and conditions of the present Terms and Conditions that are made available on the Site, in order to allow the Customer to print and save these Terms and Conditions for future reference. A copy of the following Terms and Conditions will be provided by Verso to the Customer pursuant to the prevision of the following paragraph. 5.4 of the present Terms and Conditions.
    5. All the purchase agreements entered with Verso by accessing the Site are governed by the Belgian law.

    2. Product Availability

    1. The Products available for purchase online are: handbags, shoes, clothing, small leather goods, luggage, jewelry, watches, sunglasses, gifts, fragrance, baby articles and other goods sold by Verso NV. All the Products are subject to the availability at the time of the order.
    2. Verso reserves the right to vary at any time the quantity and/or the type of products that may be purchased on the Site. The Customer will be informed if the Product requested is not available.

    3. Prices

    1. All prices on the Site are stated in Euro and they include Belgian Vat. The prices are not comprehensive of the shipping and delivery charges.
    2. Verso is not responsible for any foreign customs or duties that may be applied after shipment. Please check with your local customs agent before ordering from Verso.
    3. Verso uses it’s best endeavor to ensure that all pricing information on the Site is accurate, but cannot guarantee the absolute absence of error. In the event that an error in the price of a Product shall occur, Verso will allow the Customer the option to confirm the purchase of the Product at the correct price or to cancel the order. If Verso is unable to contact the customer the order will be treated as cancelled.
    4. The ownership of the Product purchased on the Site will be transferred to Customer at the moment of the delivery on condition that Verso has received the payment for the entire value of the goods . In any event the risks of damages and or loss of the Product are transferred to the Customer at the time of the delivery.

    4. Ordering a Product

    1. The details and the price of the Product are detailed in the single page of each Product listed on the Site.
    2. To purchase the chosen Product the Customer shall complete, following the instruction indicated on the Site, and send to Verso, the online purchase form. The Customer shall add the Product to the "shopping bag" and after having reviewed and accepted the shipping expenses, the Terms and Conditions and the general cancellation policy. The Customer shall then choose the manner in which he/she wishes to pay and the shall proceed to the option "purchase/buy".
    3. Shall the Customer need to amend or modify the data inserted in the order placed, Customer shall follow the proper procedure for the amending of the order as indicated in the Site before submitting the order. Moreover the Customer may amend or modify the number of Products he/she wishes to purchase, adding or deleting one or more Products from the shopping bag.

    5. Purchase Agreement

    1. The purchase agreement entered by and between Verso and the Customer shall be considered completed and duly entered by the Parties at the time in which the order is duly submitted by the Customer - in accordance with the purchase procedure indicated on the Site and after that Verso has received the authorization from the credit card issuer that the payment is accepted.
    2. The order submitted by the Customer shall be binding for Verso only if the entire purchase procedure has been duly and correctly completed without any error or traced by the Site. Verso is not responsible for any eventual errors caused by the technical malfunctioning of the Customer’s internet connection service.
    3. By submitting the order to Verso the Customer acknowledges and states that he/she has reviewed and accepted all the indications provided in the purchasing procedure and he/she entirely accepts the present Terms and Conditions.
    4. The online order form will be stored in the Sites database for the time necessary for the fulfillment of the order.
    5. Verso will send to the Customer an e-mail confirming the receipt of the order placed by the Customer; a summary of the Terms and Conditions, Privacy Policy and any special previsions that may apply to the agreement, a summary of the Product(s) ordered, the details of the products purchased, the time and date of the purchase, the details of Verso to which the Customer may send the eventual complaints, the commercial warranties, the terms for the withdrawal from the present purchase agreement, the formalities and the timing for the return of the Products, the payment modality chosen by the Customer, the prices of the Product(s), the shipping expenses. The Customer shall immediately verify the content of the e-mail and shall notify immediately Verso of any error or other mistake.

    6. Payment

    1. The Customer may pay for the Products and the shipping expenses by credit card. Verso accepts mayor credit cards.

      • MasterCard
    2. The transaction will be charged to the Customer’s credit card only once the credit card data has been verified; and only after that Verso has received the debiting authorization from the credit card issuer and Product availability has been verified by Verso. The Customer’s credit card will be charge only once the order is ready to be shipped.
    3. The card will not be charged at the time of the submitting of the order.

    7. Shipping and Delivery

    1. For security reasons the Product(s) purchased on the Site will be sent to the registered address on the credit card. At the time of delivery an adult of over 18 years of age shall be present to sign the delivery documents. Delivery cannot be made to P.O. Boxes and these orders will not be processed.
    2. For each order completed on Site, Verso, will issue an invoice for the shipped Products, sending it via e-mail or mail to the Customer
    3. For the issuance of the invoice Verso will refer to the data provided by the Customer. Once the invoice has been issued no modification of the same will be possible.
    4. The shipping and delivery expenses are to be borne by the Customer and are clearly indicated in the online form.
    5. All the Products will be shipped via UPS or other courier (hereinafter Courier) which will be dispatched the next working day following the confirmed availability and charge of the order.
    6. The order will be dispatched between Monday to Friday, excluding local and national holidays and festivities. Verso is not responsible for unpredictable delays, notwithstanding that, except for cases of Force Majeure, the Product(s) will be delivered within a maximum of thirty (30) days following the day after the submission to Verso of the order by the Customer. Unless other specified by the wait time specified on the order
    7. For the delivery of the Products the Customer or a person authorized by the latter shall be present at the address indicated in the order. At the time of the delivery by the Courier, the Customer shall verify:
      • that the number of the boxes are same as reported on the transportation documents (DDT);
      • that the packaging is not damaged, or wet or in another way tapered with. Any damage in the packaging and or in the Product(s) or any discrepancy between the number of the boxes actually delivered and the number of the boxes indicated on the transportation document, shall be immediately notified by indicating it in writing on the Courier’s delivery documents. Once the Customer has signed the Courier’s transportation document, the Customer may not oppose objection on the external characteristic of the delivered goods.
    8. In the event that, due to sudden and temporary unavailability of the Products, Verso shall be able to delivery the goods, Verso shall promptly inform the Customer, and in any way within thirty (30) days via e-mail.

    8. Tracking number

    1. Once the Product(s) have been sent Verso will send an e-mail to the Customer. Furthermore, Verso will send to the Customer a confirmation of the delivery once Verso has received from the Courier the notification of the delivery.
    2. In order to guarantee the security of the delivery of the Products Verso will not provide the Customer with the tracking number, but Verso will keep the tracking number of each delivery.

    9. Return and cancellations

    1. The Customer has the right to withdraw from the agreement without any penalty and without specifying the reason within the term of 7 (seven) working days from the receipt of the Products, save the previsions of following paragraph.
    2. The Customer may withdraw from the present agreement and shall send a written notification at the following address:

    1. The written communication with return receipt shall contain:
      • the express will of the Customer to avail himself of the right to withdraw from the agreement;
      • the details of the Products in relation to which the Customer wishes to withdrawal;
      • the order number issued at the time of the purchase.
    2. The above notification may be sent within the above stated period of 7 (seven) working days also via telegram, telex, fax. Verso will use it’s best endeavors to satisfy the Customer. Moreover once the product has been sent the order may no longer be modified nor deleted until the Products has been duly returned to Verso. To this extent please refer to the prevision of the paragraph 9.3. below.
    3. The purchased goods may be returned within maximum 7 (seven) days from the delivery date. The refunds will be issued in the same form as was utilized for payment. The Products purchased online cannot be refunded nor returned in the Verso shop.
    4. All the delivery expenses for the return of the Products including any duties, taxes and/or customs charges that are incurred on the package (on both the original and return shipments) shall be borne by the Customer: each and any cost borne by the Customer for the return is not refundable. These amounts will be subtracted from the merchandise refund.
    5. Verso reserves the right to refuse the return of those Products that do conform to the prevision of the below paragraph 9.6. The delivery cost are not refundable.
    6. Verso will refund the cost (except for what is mentioned under point 6 above) of the Product(s) that are returned by the Customer not worn, not used and not damaged and accompanied by relevant the invoice. Each delivery contains easy to follow instructions for the return of the Products. Verso, undertakes to promptly refund the Customer within (30) thirty days from the written order cancellation request and receipt of the goods. Once the refund has been completed Verso will send a confirmation e-mail.
    7. Verso recommends to use a courier for the return of the Product(s) in order to allow the tracking of the shipment. Verso will not be held responsible for the refund or the compensation of those Products that have been lost, stolen or damaged.
    8. All items purchased during the sales period,  or at a discounted price, are non-exchangeable and non-refundable. All sales of such items are final.

    10. Errors and mistakes

    1. Verso uses it’s best endeavors in order to keep the information on the Site constantly updated.
    2. Moreover it is not possible to guarantee the complete absence of errors on the Site. The Site might carry typo’s, errors, inaccuracies some of which may refer to the price of the Product, to the product availability and/or to the details of the Products.
    3. Verso reserves the right to amend the errors and inaccuracies also after that the order has been submitted and furthermore reserves the right amend or modify the information on the Site at any time without prior communication.

    11. Guarantee of Authenticity

    1. Verso guarantee the authenticity of all the Products purchased on the Site.
    2. The Products marked Verso are crafted with the best materials and are made by the best craftsmen.
    3. No page or other content of the Site may be reproduced without the prior written approval of Verso.

    12. Defects

    1. Shall a Product purchased by Verso show a defect, the Customer shall immediately contact the customer care at the following address:

    1. Shall the Customer be unsatisfied and/or for any discrepancy with the order submitted by the Customer, the Customer shall keep all the papers, the Product and it’s box and contact immediately the company via e-mail at the following address: ignacio@verso.be

    13. Applicable law and jurisdiction

    1. The terms and condition and contractual relationships between Verso NV and the Customer are regulated by the Belgian law and shall be interpreted in pursuance to the Belgian laws. In case of disagreement, parties shall seek for an amicable solution before going into court. The Customer accepts the exclusive jurisdiction of the Belgian courts. For any controversy arising from or in connection to the navigation or the use of the Site the competent court shall be the court of Antwerp.
